Terms of Service
In short
- TierNation is a free, fan-made tier list for Minecraft PvP. It isn't run by Mojang or Microsoft.
- You need to be old enough to use Discord where you live, and you may only claim your own Minecraft name.
- Your tiers, test history and profile are public. You can hide your profile or delete your account at any time.
- Tiers are our testers' judgement. We may change, void or remove them, and ban anyone who breaks the rules.
- The service is provided as it is, without guarantees, and our liability is limited as far as the law allows.
1. About these terms
These Terms of Service ("Terms") are an agreement between you and TierNation ("we", "us"), who run TierNation. They cover the website at https://tiernation.club, its public API, our Discord server and bot, and the TierNation client mod (together, the "Service").
By using the Service, or by logging in, you agree to these Terms, to the Community Rules and to the API and mod terms, which are part of these Terms. Our Privacy Policy explains how we handle your data. If you don't agree, please don't use the Service.
2. Who can use the Service
You must be at least 13 years old, and old enough to use Discord in your country (for example, older in some countries), to create an account. If you're under 18, or under the age of majority where you live, please read these Terms with a parent or guardian, who agrees to them on your behalf.
You can't use the Service if we've banned you, or if the law where you live forbids it. Browsing public pages doesn't need an account.
3. Your account
- You log in with Discord. Your Discord account is your TierNation account, and you're responsible for what happens with it. Keep it secure; tell us if you think someone else has used it.
- One account per person. Don't share, sell or transfer accounts, or make extra ones to get around a ban, cooldown or tier.
- You may only claim a Minecraft name that is yours. Premium (paid) names must be verified, with the skin check or with Microsoft; unverified claims are released after a while. Cracked names must not belong to a premium account. We may release, rename or reassign a name that was claimed wrongly or that a verified owner proves is theirs.
- Information you give us must be true, and you must keep your region and name up to date.
4. Tier tests and rankings
- Tiers come from matches against our testers and reflect their judgement on the day. They aren't a guarantee of skill, a qualification or a promise of anything, and other tier lists may rank you differently.
- We decide how testing works: gamemodes, regions, formats, queues, cooldowns, points, titles and seasons. We may change any of these, and retest, move, void, retire or reset any tier, including after it's published, for example when a result was wrong or a rule was broken.
- Nobody is entitled to a test, a particular tier or a place on a leaderboard. Testers are volunteers and queues open only when testers are available.
- If you disagree with a result, ask for a review as described in Moderation and appeals.
5. What is public
Rankings are public by design. Your Minecraft name, UUID, skin, account type, region, tiers, points, titles, badges, past seasons and test history are shown on the website, in the API and the mod, in link previews, and in result posts on our Discord server, which can mention your linked Discord account. Others can see, copy and share that public information, and we can't control copies they make. You can hide your profile or delete your account at any time; see the Privacy Policy.
6. Rules of conduct
You must follow the Community Rules. In short: no cheating, no impersonation or alt abuse, no harassment, no attacks on the Service, and no breaking the law or the rules of Discord, Mojang or Microsoft.
7. Content you give us
You keep the rights to what you give us, such as evidence links, messages in tickets, requests and appeals. You give us a free, worldwide, non-exclusive licence to host, store, copy, show and share it as needed to run the Service (for example, showing an evidence link with a result). This licence ends when the content is deleted, except where it is part of a record we keep as the Privacy Policy describes.
You promise you have the right to share that content, that it is lawful and that it follows these Terms. We may remove any content at our discretion.
8. Our content and other people's
The Service's design, text, graphics, logos and code (other than open-source parts, listed in Open-source licences) belong to us or our licensors. You may share links and screenshots of public pages, and use public data as the API terms allow, but you may not copy the Service itself or present it as yours.
Minecraft is a trademark of Mojang Synergies AB. Minecraft names, skins and game assets belong to Mojang, Microsoft or the players who made them. We use them under the Minecraft Usage Guidelines, and TierNation is not an official Minecraft product; see the Disclaimer. Discord is a trademark of Discord Inc.
If you think something on the Service infringes your rights, see Copyright and takedowns.
9. The mod and the API
Using the client mod or the public API is covered by the API and mod terms. The mod is open source under the Mozilla Public License 2.0. You use it at your own risk, and you're responsible for making sure it's allowed on the servers you play on.
10. Other services
The Service relies on Discord (to log in and for our server and bot), Microsoft and Mojang (to verify accounts and show names and skins), and our hosting provider. Their own terms and privacy policies apply when you use them, and we aren't responsible for them or for sites we link to.
11. Suspension and ending your use
You can stop using the Service and delete your account at any time from your account page.
We may warn you, remove content, void tiers, block you from queues, hide your profile, or suspend or ban your account or Minecraft name, if you break these Terms or the Community Rules, if the law requires it, or to protect players or the Service. We'll tell you why and how to appeal, as described in Moderation and appeals, unless the law or safety reasons stop us. Sections 7, 8 and 13 to 18 survive the end of these Terms.
12. Changes to the Service
The Service is free. We may change, add or remove features, gamemodes and data, or stop the Service, at any time. We don't promise it will always be available, error-free or that data will never be lost, though we try to give notice of major changes on the website or our Discord server.
13. No warranty
The Service is provided "as is" and "as available". As far as the law allows, we give no warranties of any kind, express or implied, including that it is accurate, complete, reliable, fit for a particular purpose, non-infringing, secure or uninterrupted. Tiers and other content are opinions and may be wrong or out of date.
14. Limitation of liability
As far as the law allows, we (and our staff, testers and volunteers) are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, reputation, opportunity, team places, prizes, profits or goodwill, arising from or related to the Service, even if we were told it might happen. Our total liability for all claims about the Service is limited to the greater of the amount you paid us in the twelve months before the claim (the Service is free, so normally nothing) and 50 US dollars.
Nothing in these Terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, for fraud, or your rights as a consumer under mandatory law where you live.
15. Your responsibility to us
As far as the law allows, you agree to cover our reasonable costs and losses (including legal fees) arising from claims by others that are caused by your breach of these Terms, your content, or your misuse of the Service. This doesn't apply to the extent we caused the loss.
16. Governing law and disputes
These Terms are governed by the laws of INDIA, and the courts of INDIA have jurisdiction over disputes about them. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring claims in its courts.
Before going to court, please contact us at [email protected] so we can try to settle the issue informally. We'll answer within 30 days. EU consumers may also use their national consumer dispute services; we aren't obliged to, and generally don't, take part in alternative dispute resolution.
17. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. For important changes, we'll give notice on the website or our Discord server at least 14 days before they apply, unless a change is needed sooner for legal or safety reasons. If you keep using the Service after a change applies, you accept the new Terms; if you don't, stop using it and you may delete your account.
18. General
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we don't enforce a right straight away, we haven't given it up.
- These Terms, with the documents they refer to, are the whole agreement between you and us about the Service. You may not transfer your rights under them; we may transfer ours to whoever takes over the Service, without reducing your rights.
- These Terms are written in English. If a translation differs, the English version applies, unless the law says otherwise.
